Corti Mr. H,G, Verkerk i, The Chairman welcamed the participants and asked Mr, Simpson to lead the meeting, 2, Mr, Simpson suggested and all agreed that Mr, Vetkerk act as secretary, · ·~ BATCo document far Legal Services : Health Canada 21 May 1999 REVIEW OF THE AGENDA 3, There were no comments an the agenda, II, CONFLRMRTION OF MINUTES ur. ulnscroas' MEETING, APRIL 2, 19BS OF DIRECTORS' MEETING 4, Miner amendments to'pa~as 32, 37, 38 and 51 of the draft Minutes had been received before the meeting and had been incorporated in the Minutes tabled at the meeting; : 5, Mr, Simpsoo briefly reviewed the latest developments on paras 13 to 21 of these Minutes, 6, Paras 13 and 14 referred to the preparation of a response to an article in a prominent British newspaper which was critical of de-forestation and implicated certain companies, 7, Although a response was prepared, this was not forwarded to the newspaper as it was subsequently judged that such action was inadvisable, 8, Following from para 21, Mr, In.arcotullio exhibited some Icelandic packs with the new graphic warning labels, Elr.Simpson will show these materials to the regional African and Latin American workshops, 9, Mr, Whist referred to the excellent paper produced by the T.I, of Australia opposing the proposed introduction of four rotational warning clauses covering 20% of the front and back of the pack end all advertisements, lie asked if this could he circulated to NMAs and member companies, 10, Ms, Cotti agreed to do this after receiving approval from the T,I,A, 11, The Minutes were then confirmed,' ~ BATCo document for Legal Services : Health Canada 21 May 1999 REPORT FROM THE SECRETARY GENERAL III,1 Mr, Simpson Ectwnented on the Secretariat's report to the Board: 12, He emphasized the strong coordination of the anti-tobacco campaigners and their increasing pressure an all tobacco issues, 13, Mr, fly outlined the background of a case whereby the British Overseas Aid Ministry were reviewing the eligibility for grants on the export o~ Si 1/2 aillion's worth of tobacco machinery to affiliates in Zimbabwe, Reasons given were that the item constituted more than 101 of the total grant·in-aid package of ~10 million and that no aid was available for tobaeeolrelated items, 14. After concerted action by NMAs and companiesr including Molins, in the O,K,, Zimbabwe and Malawi, the Ministry stated they would continue to support tobacco-related activities, 15, This result was a prime example of coordinated action by HlnA5 and companies having a positive influence on a governmental measure affecting tobacco, 16, Mr, Vogel requested that the secretariat keep a close eye on any new developments which might adversely affect member companies, 17, Mr, Cullman described the present situation on warning labels in the U,S,A, where, as from October 1985, four rotating warnings are required for cigarette packs, BATCa document for Legal Services : Health Canada 21 May 1999 is, At the same time, the Smokeless Tobacco Association, to which several cigarette manufacturers also belong~ is opposing legislation to place certain warning labels on their products, 19. Mr, Cullman emphasized the importance of air tobacco products manufacturers taking a consistent line in dealings with government on the issue of warning claims, 20, Mr, Cullman stated that the issue of cigarette i~redients has been highlighted in the U,S,A, by several claims involving Indonesian "kretek" cigarettes, 21, The matter is expected to create great interest in Congress in advance of the October deadline for all U,S, manufacturers to submit a list of ingredients to government, 22, Ms, Corti tabled a case in Canada whereby the Non-Smokers' Rights Association filed a complaint with the Ministry of Consumer and Commercial Relations of Ontario against Rothmans for allegedly violating a section of the Business Praetiees Act by not disclosing publicly the "materia~ fact" of the "addictive" nature of tobacco. 23, After nearly a year the Ministry replied that the complaint could not be upheld as the "addictive" nature of cigarette smoking had not been established as a fact in a legal sense, 24, Mr, Simpson tabled the Secretariat's expenses against budget for the first half of 1985 which showed a favourable balance · of 11,5 million B,F, BATCo document for Legal Services : Health Canada 21 May 1999 Information Services Ms, Corti referred to her written report and invited carrsaents. 25, Referring to mfotab's Database (item III.2,e) she asked whether this Could be extended to include more S c H basic articles and reviewsin view of increasing requests from members for information tailored to their circumstances, 26, After discussion it was agreed that the database could be extended to include certain~ additional S 6 H published documents, 21, The Board requested that Infotab should consult with Mr, Heel concerning the type and context of response to NMR requests on S ~ H subjects, 18, Referring to item III,Z,e (Perscnnel), Ilr. Vogel was assured that no security problems had arisen with staff turnover, 29, Ms, dosti highlighted ~nfotab's plan far the preparation of i workshops in 1986 for the training of NMA personnel in i responding to smoking issues, 30, Mr, Cullman agreed that every assistance should be given in the design cf prograranes for N~nA personnel as they are the ideal entity for responding to such issues, Mr, Whist added that the T,I, of Australia las well as the T.I. in the U,S,) runs seminars for industry spokespeople, Personnel from ether NMAs should be encouraged to attend, BATCo document for Legal Services : Health Canada 21 May 1999 32, Mr, Wbist offered assistance with the programme design and would show the Secretariat a copy of a PM film on the training of spokespersons, He emphasized that nobody should be allowed to speak publicly on any smoking issue without thorough training, PI.3 Report on Activities Being Undertaken a) European Economic Impact Study 33, Mr, Simpson brought the meeting up-to-date with the latest developments: there will be 3,000 copies each in French and English and a summary in 6 languages the European associations which took part in the study will be listed separately the study will, be officially presented to EEC departments and economic journalists by John Lepere and PIof, nonald MaeKay (PEIDA) on September 24 in due course each N~LA is expected to make a t~resentation to its own MEPs and use the study as they consider appropriate in their country, 34, Mr, Vogel asked whether the presenters on September 23 were prepared to answer questions on tobacco subsidies, bearing in mind that tobacco is the second largest subsidized crop in Europe, 35, Mr, Webb asked who would take responsibility for the accuracy of the data in the study. 36, Mr, Simpson stated that PEIDA ale responsible for the contents of the study and will respond to any questions relating to them, Gs Mr. puattrara, in charge of EEC tobacco agricultural policy, will also be at the O jillllllilfi., .uOllid bl bill Illld ~O IIIPPTd tC Y questions concerning subsidies, etc, iV BATCo document for legal Services : Health canada 21 May 1999 37, The meeting felt that Mr, Simpson should discuss these points with John Lepere and lir, Quattraro prior to the presentation, b) "Sma_king and Society' 38. Mr, Marcotullio reported that publication is expected in September and 500 additional copies will he printed in Spanish, 39, Copies will be available to delegates at the topenhagen workshop where Michael Thompson (N,Z,) will make a ti~ I:ltnoY.~" b;r to n.l ~i.b.li u. oi thr uY.I 40, Mr, Cullman suggested asking Robert Tallison to present the J work to certain key centres and NMAs and companies will also consider a series of presentations by the individual authors in their countries, C) Youth and Advertisiqq 41, Mr, Simpson commented on the survey being undertaken and mentioned that Rothmans had offered assistance with the project, 42, Mr, Vogel stated that Prof, Bergler had also done extensive research on advertising and young people and urged companies to make use of his expertise, sadors in Geneva and R6me d) Presentations to Ambas in ~ !neva anc_ ~ . 43, Mr. Veskerk commented on his written report and highlighted the interest and sympathy encountered at these meetings by industry representatives, BA~Co document for Legal Services : Health Canada 21 May 1999 44, Particular interest: was shown by the Mexican Ambassador to the U,N,, Geneva in coordinating the defence of tobacco growing with his colleagues in other countries and he expressed a wish to discuss this with a tap tobacco company executive, 45, Mr, Cullman declared himself prepared to visit the Ambassador but stipulated he be accompanied by executives of the Mexican companies and possibly a London Director of BAT, 16, He felt that apart from answering the questions which the Ambassador posed in May, consideration should be given to requesting certain initiatives from the Ambassador, 4'1, Ms, Corti will discuss these matters with the Mexican delegate to the Latin American regional workshop in Miami and it is hoped that the Mexican Ambassador can be visited during September, 48, Mr, Cullman suggested that the ambassadorial contacts be extended to other tobacco-producing countries, such ·as in the EEC, and the meeting felt that these could best be left to the NMAs concerned, Mr, Whist stated that no presentations should be made to Turkish diplomatic representatives for the time being, e) The Middle East and West Africa Working Groups 50, The meeting felt that more progress could be made in the C Middle East if the Committee were up-graded to include company representatives with more authority to speak and comment for their respective companies. Mr, webb suggested that new terms of reference be drafted for the M,E,W,G, and the meeting felt that Mr, Simpson should assume the chairmanship, 52, The W,A,W,G, was deemed to be working satisfactorily, ~J BATCa document for Legal Services : Health Canada 21 May 1999 III,4 Report on Workshop~ a) b) cl Regional wor)tshops - Rsij/Pacific, A~siea, Latin America 53, Mr, Simpsan, Verkerk and Ms, Corti comment~d an these workshops, d) Copenhagen - Oct, 8-10 54, Mr, Mareotullia and Mr, Heel expressed concern about ce~tdin scheduled presentations, 55, Mr. SimpsDn was asked tolobtain draft presentations in advance of the workshop and consult Mr. Heel, 56, Mr, Vagel suggested that Mr~ Hael or Mr, Simpson make a presentation at the workshop explaining the sensitive legal situation in the USA and the possible impact of certain statements on the industry in general. 57, Mr, Cullman proposed making a video tape of recognized i scientific authority to respond to the expressed needs of most NMAs, 58, Mr, Whist suggested that portions of the workshop be video-taped far the purpose of portraying same of the J functions of Infotab to NE~As and executive s of member companies, se v6uld address himself to the logistics involved, BATCo document for Legal Services : Health Canada 21 May 1999 IV, THE "PASS~frE" SMOKIE~G ISSUE 59, The overview of the scientific li:enture on this subject, prepared by the Secretariat, was considered excellent, 60, This paper was far the exclusive use of Board members and their companies, but should not be circulated to NEibs, 61, Mr, Simpson tabled "mock-ups" of two brochures which could be over-psieted with the name of NAAs and lead companies, and which contained a review of the scientific and public policy aspects of "passive" smoking, 62~ it was agreed that these he circulated to certain NMA5 after comments of member companies had been received and considered, 63, As the major NMAs have their own publications on the subject, the brochures would be for the use of other NMAs and lead companies, The text should not be altered and ~nfotab should keep charge of the printing. Spanish translations will be arranged by the Secretariat. 61. Mr. bel reviewed the various scientific projects being undertaken in the U,S,A, and Mr, Vogel mentioned some of the work being done in Germany. 65. After discussion, the need was expressed for a better coordination of effort and information sharing to be supervised by Bessrs, Heel and Simpson, 66, Err, Culllnan suggested that the morning of october 1 in Copenhagen be devoted to a review of· the whole Ipassive" ii smoking issue by the Board with selected IMA personnel and eimtlna ~articipa:ing, iii uaE agreed. BATCo document for Legal Services : Health Canada 21 May 1999 V, ECONOMIC IMPACT STUDIES (REGIONALJ 61, Mr, Simpson stated there was scope for regional st~dies in Latin America, Asia and the Caribbean, 68, It was decided to wait with these studies until the 1 reactions from the European Study had been evaluated, VI, COMPANY INITIATIVES 69, Mr, fly proposed three projects which BAT were Prepared to undertake: a) Children and Advertising in Kenya b) Follow up'existing FAO data with a study of the "small tobacco farmer", PM would join BAT in such a study, c) A study on the complementarity of food and tobacco growing, There was general agreement that this should be carried cut and Mr, Cullman mentioned that provision for this could be made in Infotab's budget for professional fees, 70, Mr, Cullman suggested that the relevant companies should give attention to: a) improving the Middle East Working Group b) dealing with Lars Broch and the I,O,C,O, c) finding out how the Consumers Association of Denang (Halaysia) is funded, Mr, Verkerk undertook to write to Malaysia spain and ask them to contact the head of the Chamber of Commerce who may be able to help, BATCo document for Legal Services : Health Canada 21 May 1999 12 vIl.
