Mr Stephen Dorrell MP ~arliamenta~? Under-Secretary a[ State The Depart~ent of Health Richmond House 19 whitehall London SW1A 2H5 28 ~~ovenher 199! Dear Mr Dorrell, TOBACCO ADVERTISING: DBSERIER ARTICLE Follovin9 the nisieadic~ and inaccurate article which aFf!~red in the 10 Elovember issue of the Observer, which seens to h?ve stimulated the Adjournment Debate on Monday 2 December,:'lhO'J9ht it might be helpful to put the record straight. Imperial Tobacco Itd, the company referred to in the article, is an associate company of B.A.T Industries in Canada, 401 stake and has no director on that company's board. I would like to state categorically that BbT believes tha: smoking is an adult choice. It is our policy worldwide not to direct advertising to children nor in any Way encourage them to s·moke. furthermore we support unreservedly the efforts o~ authorities to prevent the sale of cigarettes to non-adults. Imperial Tobacco did not and does not advertise to non-saokers or to anyone below the legal age to buy ci4arettes, Canadian federal law farhids the sales of cigarettes to Feople aged less than 16, The Canadian Tohacce Manufacturer's Council, the industry association in Canada which represents Imperial Tobacco, has supported a national campaign by the Retail Council of Canada to inform retailers of the existence of fedenl and provincial legislation and to post signs in their storesto discourage underaged children to buy cigarettes, 12~·. BAT Industries document for Legal Services : Health Canada 21 May 1999 -2- The Observer article iFccuses on documents which Imperial Tobacco presented during a year-long trial in M~ntreal. This trial resulted in the judg~ent that the Canadian ban on tobacco advertising is unjustifiahle in a free and denocratic society~ The )udrment nowhere found anything reprehensiSle in either t"e advertising or the advertising strategies of Ispe:ial Tobacco. Nevertheless, tbe observer alleged :ha: I~peria! Tobacco aimed its advertising at people und~ec the age of 16. This is not tI?ie. The Observer focused on a document which contains references to the ace group of 12 to 17. However, this document does not deal with the content of or the targeting of advertising It c0"tains information supplied by a third party, the Print Measurement Bureau, showing the readersbiP profiles o[ Pa4azi"est Imperial did not request infonation on people belav the age of 16 and had in fact requested a ;aore refined banding, ie 16 and over, but PMB were unable to provide infornation In this forml The PMB is an organisation suFFlyi"9 standardised information on readership of magalines to any marketer Wishing to purchase such intormation. In other words, the age hand of 1l to 11 was one supplied by an external agency and nor one originated by Imperial Tobacca~ When, two years later, PMB made new groupings available, Imperia1 were able to receive infonation on 16-19 year olds and 20-21 year olds, Imperial immediately began using those aev conputer treakdavns and have done so since. For your infonation you say be interested to see the policy statement on this issue adoeted by OUr UX subsidiary, British-American Tobacco. I also enclose a letter from the Chairman and Chief Executive Officer of Imperial Tobacco to the Observer editor, Mr Trelford, I would be happy to Fr,vide !ou'ith any i"rther information which you may feel Would be helpful.
