Proctor DATE: 3 December 1993 SUBJECT: TSG Briefing Notes on Smoking Issues - Additional Item Environmental Tobacco Smoke Staius qfEPA Lawsuit Philip Morris and R.J. Reynolds, among others, have undertaken legal action aQL= the United States Environmental Protection Agency over that Agency's release of a ri-111- assessment of environmental tobacco smoke (ETS). We are informed that this legal action has reached a critical stage. It is likely that oral arguments will be heard over the next few weeks, leading to a decision on whether the case should be dismissed. !, dismissal of the case at this stage would most probably, albeit inaccurately, result in claims that the courts have upheld EPA!s decision to classify ETS as a "known hunan carcinogen."
